Each and every service rendered by the Texan Webmaster Web Design is done so under the following terms and conditions. Our policies are designed to provide a safe environment for the client and also Texan Webmaster Web Design. If there is anything not accepted or agreed upon that is contained in these terms and conditions, do not contact us for any service, quote, or graphic design services. When making the choice to hire us, you are also agreeing fully to the terms and conditions as they are stated here.

 

Quotes 

Quotes will be given out to any client or prospective client and will be good for 30 days only. New quotes will be rendered at the request of the individual.

 

Contracts 

Contracts given to clients or prospective clients are also only good for 30 days if it is not a signed contract. If the individual so chooses, they may request a new contract be drawn up.

 

Fees and Charges 

Any new web design project that costs $700 US or less will be divided into two separate payments. Half will be due when contract is signed and the remaining half will be due when the project is completed and accepted before it will be cleared to be released for the client or used on the internet.

 

Any new web design project over $700 US will be divided into three equal payments. On-third will be due when the contract is signed; one-third upon acceptance of the design, and the final third will be due when acceptance of the completion of the projects is given before releasing it to the client or using it on the internet.

 

Any final payment that is not received by Texan Webmaster Web Design within 10 days of being notified will be assessed a $25 per day late fee. After five days of non-payment, collections will begin. Checks that do not clear will be assessed a $35 return check charge.

 

To schedule a project to be added to the waiting list, it will be necessary to send a deposit of 25% within 2 months of the beginning start date for the project.

 

Credit for the Web Design 

Each and every website design created by the Texan Webmaster Web Design has a mandatory text link back to www.TexanWebmaster.com. Each client must agree to leave this link on the web design until the particular design is removed from publication on the internet. Removing this link from any of the designs will violate this agreement.

 

Ownership and Copyright

Texan Webmaster Web Design will retain all copyright to any and all completed website design products they produce. The client will be given the right to use the web design project as a website when all the payments are complete for the production of the project. All rights to any photos, source code, graphics, and computer programs are not specifically transferred to the client and will stay in the possession and ownership of the Texan Webmaster Web Design or any of their third party recipients.

 

Any custom web designs, graphics not accepted by the client, or any other type of graphic that remains unpaid or not in legal use by the original client and created by Texan Webmaster Web Design will be resold.

 

Refund Policy             

Each project requested through Texan Webmaster Web Design will require a deposit. If, for some reason, the client wishes to terminate the project, it will need to be sent in writing. If the written termination is received after the website creation process has started, part of the original deposit will be kept. The refunded amount of the deposit to the client will be minus the original hours already completed times $10 hour. Refunds may take as long as thirty days to be processed. If the amount of time work on the design exceeds the amount of the deposit, a bill will be sent for the difference. Once this payment is received by Texan Webmaster Web Design, any work completed before the termination date will be released to the client. Client non-payment of the invoice will result in immediate collection action which will have an affect on your credit score and overall financial reputation.

 

We hold all right to any of the graphics and projects development, not including graphics and content provided to us by the client, until all payment is made for these items. (Refer to the ownership and copyright section)

 

Because Texan Webmaster also resells the Kayako Licenses for a larger company, we are not offering refunds on these licenses, domain services, or SSL. If, for any reason, you are not satisfied with the services for hosting you have been provided with, we will be glad to work out a comparable solution that will work with the needs of your company.

 

Chargeback’s

 There will be no negotiation of any chargebacks whats so ever. If any client or company chooses to go through with a chargeback, Texan Webmasters will immediately and without haste, proceed directly into collections and legal proceedings to recover any funds lost in the transaction.

 

Development and Delivery

Texan Webmaster Web Design respects the importance of having projects completed on time and in an agreeable manner. For this reason, we will agree to have all web design projects completed within a 60 day time from the signing of the contract. All of the complete text, graphic content, and any other material requested must be sent to Texan Webmaster Web Design within 30 days after the contract is signed or the contract will become void and all client rendered deposit is forfeit. If the client would like a Project Extension, it must be sent to Texan Webmaster in writing and an additional 20% fee on the complete cost of the design will be due for each thirty day extension needed. All fees for extensions will be due at such time as Texan Webmaster web design agrees to the extension.

 

Client Non-Communication

If Texan Webmaster is unable to reach a client during the development and design process of the project, the project will be stopped with given notice and the any payments will become nonrefundable. For at least 60 day by either phone or email.

 

Liability

Any service purchased from Texan Webmaster comes with a seven day warranty. This warranty will provide the client with free corrections and adjustments tot eh website. Texan Webmaster Web Design will not be liable for any direct, indirect, punitive, special, consequential, or incidental damages that come from using the services, website, and/or data loss or any other loss resulting from the direct use of the goods, services, and website the client has been provided. The client has the sole responsibility of the performance and quality of the web design.

 

International Customers

Project requests from International clients is gladly accepted but requires full project payment prior to the start of the project. Payment will only be accepted by credit card for international clients. Absolutely no exceptions will be made!

Project Consideration

Texan Webmaster Web Design is a family owned and operated company. Because of this, any project that is found to be questioned morally, not ethical, or in bad taste will not be accepted. All websites requiring a viewer to be 18 or older will also be turned down.

• Notice: This Agreement is under the governing forces and created in relationship to the laws of the state of Texas. Exclusive jurisdiction and venue is as governed in the district court of Brazoria County, Pearland Texas.

 

Acceptance

Submission of the down payment for services means the client or company rendering the deposit agree completely with each and every terms of service posted here. This agreement can be changed or updated at the discretion of Texan Webmaster Web Design at any time without prior notice.
